The administrator of personal data is xBerry Ltd. The personal data provided to us will be processed, in particular, to enable us to contact you. Therefore, you have all the rights under the GDPR, including the right of access, rectification, erasure of your data, restriction or objection to their processing, the right to data portability, the right not to be subject to automated decision-making, as well as the right to lodge a complaint with a supervisory authority. 1: DEFINITIONS

For the purposes of this privacy policy, the following meanings of the terms are accepted:

Administrator – The administrator of personal data is xBerry Ltd.

Personal data – any information relating to an identified or identifiable User.

Policy – this privacy policy.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

2: HOW AND FOR WHAT PURPOSE DO WE COLLECT YOUR PERSONAL DATA?

Users may provide their personal data to the Administrator through forms available on the website, such as the account registration form or the contact form.

The Administrator of the User’s personal data is IRDIS Ltd.

The data provided to the Administrator within the account registration form is processed for the purpose of providing shipping-related services. This data includes first name, last name, mailing address, email address, phone number, and optionally tax identification number and company name. The User has access to their data and can modify, delete, restrict their processing, and withdraw previously given consent at any time.

The data provided to the Administrator within the contact form is processed for the purpose of responding to the User’s inquiry or initiating contact regarding an offer. This data will be processed until the matter of the inquiry is clarified.

The Administrator guarantees the confidentiality of all personal data provided to them.

Providing data is always voluntary but necessary to take the actions intended for a given form.

The Administrator informs that they have the right to disclose personal data to entities listed in Section 4 of this Privacy Policy. At the same time, the Administrator does not disclose the provided data to third parties not mentioned in Section 4 without the User’s consent. Exceptions are situations where legal regulations may impose an obligation on the Administrator to disclose Users’ personal data to certain authorities or third parties, such as law enforcement authorities in countries where the Administrator operates or where third parties act on behalf of the Administrator. The Administrator may also disclose or otherwise process Users’ data in accordance with applicable regulations to defend their legitimate interests, such as in civil or criminal proceedings.

User’s personal data may not be transferred outside the country where the User uses our goods and/or services, including to countries outside the European Union, where there are no legal regulations protecting personal data or where there are different regulations regarding the protection of personal data, such as the United States.

3: DATA SECURITY OF USER’S PERSONAL DATA

Personal data is collected with due diligence and adequately protected against unauthorized access by unauthorized persons. The Administrator ensures administrative, technical, and physical security measures to protect the personal data held by them from unauthorized disclosure, use, alteration, and destruction. The website is secured with an SSL Certificate, which ensures the confidentiality of data transmitted over the Internet. The transmitted data is encrypted, making it more difficult to intercept and modify.

The Administrator continually conducts risk analysis to ensure that personal data processed by them is secure, primarily by ensuring that only authorized individuals have access to the data and only to the extent necessary for their tasks. The Administrator ensures that all operations on personal data are recorded and performed only by authorized employees and associates.

The Administrator takes all necessary actions to ensure that their subcontractors and other cooperating entities guarantee the application of appropriate security measures whenever they process personal data on behalf of the Administrator.

4: WHO DO WE SHARE YOUR DATA WITH?

In order to provide services properly, the Administrator may entrust the processing of Users’ personal data to the following entities:

Service providers, such as banks and payment operators, server hosting companies, website maintenance companies, courier companies, accounting, legal, auditing, consulting firms, marketing agencies (for marketing services), etc.

Other entities in connection with corporate transactions. The Administrator may disclose User information to external entities in the event of a merger, transfer, or bankruptcy.

Administrative authorities in compliance with the law or mandatory legal procedures.

5: WHAT ARE THE RIGHTS OF USERS?

By providing us with their personal data, Users have the right to:

Information about the processing of personal data – based on this right, the Administrator provides information about the processing of personal data, including the purposes and legal basis of the processing, the scope of the data held, the recipients to whom the personal data is disclosed, and the planned data deletion period.

Obtain a copy of the data – based on this right, the Administrator provides a copy of the processed data relating to the individual making the request.

Request correction, deletion, or restriction of previously provided data by the User.

Object to the processing of User data – based on this right, the Administrator ceases operations on personal data, except for operations for which the person whose data is being processed has given consent, and their storage in accordance with the adopted retention policies or until the reason for restricting data processing ceases.

Data portability – based on this right, to the extent that data is processed under a contract or with the User’s consent, the Administrator provides the data provided by the User for transfer.

Withdrawal of the User’s consent to the processing of personal data for a specific purpose, if such consent was previously given.

Lodge a complaint with the supervisory authority regarding the processing of personal data by the Administrator. Users can contact the Office of the President of the Personal Data Protection Office for this purpose.

6: HOW TO SUBMIT A REQUEST TO CHANGE DATA?

A User can submit a request regarding the exercise of their data subject rights in the following manner: in writing to the Administrator’s address or by email at marketing@xberry.tech .

The request should, to the extent possible, clearly indicate the subject matter of the request.

If the Administrator is unable to determine the content of the request or identify the person submitting the request based on the provided information, they will ask the requester for additional information.
